Apparently, there is talk of an EU cluster. Ywain seems to be overpopulated (was hitting the 4000 cap) and Mythic have said that the EU players won't add any more load.
This could be a reference to the difference in peak times though.

No you can play any realm, but iirc there's a 10min cooldown between realm swapping. I've tried Uthgard. It's good, but levelling is extremely slow... as slow as it was when DAoC first came out. Gandelf, I suggest you check out the Uthgard server. As far as I know, there's nothing fishy or illegal about the free servers, it's an open source project.
